These Terms & Conditions ("Terms") govern your access to and use of Muninn (the "Service"), provided by Ken Ove Ferbu ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and account
You must be of legal age in your jurisdiction (or have permission from a parent or guardian) to use the Service, and, if using it on behalf of an organisation, you confirm you have authority to bind that organisation. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.
2. The Service
Muninn is a personal knowledge and notes service. Features may change over time. We do not guarantee uninterrupted or error-free operation and may perform maintenance, updates, or modifications.
3. Acceptable use
You must not misuse the Service. In particular, you agree not to:
- use the Service for any unlawful, fraudulent, or abusive purpose;
- send spam or infringe others' intellectual property, privacy, or other rights;
- interfere with the security or integrity of the Service, including probing, scanning, or introducing malware;
- scrape, reverse engineer, resell, or redistribute the Service or circumvent its technical limits.
4. Your content
You retain ownership of the content you submit to the Service. You grant us a limited, worldwide, non-exclusive licence to host, store, process, transmit, and display that content solely to provide and improve the Service. You are responsible for having the rights necessary to submit your content.
5. Intellectual property
The Service, including its software, documentation, and branding, is owned by Ken Ove Ferbu and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
6. Payments, subscriptions, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation, and refund mechanics are governed by Paddle's Buyer Terms in addition to these Terms. You can manage or cancel your subscription at any time via paddle.net.
7. Refunds
Refunds are governed by our Refund Policy and handled by Paddle.
8. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. Upon termination, we may delete your data after a reasonable export window, subject to applicable law.
9. Warranties and liability
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. Our aggregate liability arising out of or relating to the Service is limited to the fees you paid us (or that Paddle remitted to us) in the twelve (12) months preceding the event giving rise to the claim. We exclude liability for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including for fraud, death, or personal injury caused by negligence.
10. Indemnity
You agree to indemnify and hold us harmless from claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
11. Changes to the Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of Norway, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the courts of Norway, unless mandatory local consumer law provides otherwise.
